These Terms of Service (“Terms”) govern your access to and use of commonhealthrx.com (the “Site”) and the telehealth, wellness, and related services (the “Services”) offered by Alphagenix, LLC, doing business as CommonHealth Wellness (“CommonHealth,” “we,” “us,” or “our”). By accessing the Site, submitting a form, booking a consultation, or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Who We Are

CommonHealth operates a telehealth-enabled wellness platform connecting individuals in Kentucky with licensed healthcare providers for evaluation and, where clinically appropriate, prescription of GLP-1 and related medications. CommonHealth is not itself a pharmacy or a healthcare provider; clinical evaluations, prescribing decisions, and dispensing are performed by independent licensed providers and pharmacies that partner with CommonHealth.

2. Eligibility

You must be at least 18 years old and a resident of a state where our Services are offered to use the Site and Services. By using the Site, you represent that you meet these requirements and that all information you provide is accurate and current.

3. Not a Substitute for Emergency Care

The Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Nothing on the Site constitutes medical advice outside the context of an established provider-patient relationship formed through our Services.

4. The Assessment, Consultation, and Prescribing Process

Use of the Site may involve completing a health assessment, scheduling a consultation, and, where a licensed provider determines it is clinically appropriate, receiving a prescription. Providers exercise independent clinical judgment. Completing an assessment or consultation does not guarantee a prescription, treatment plan, or specific outcome. No statement on the Site should be interpreted as a promise of results.

5. SMS / Text Messaging Terms

By providing your mobile phone number and checking the applicable consent box, you agree to receive text messages (SMS/MMS) from CommonHealth at the number provided, including appointment reminders, scheduling links, follow-up communications, and account-related notices.

  • Message frequency varies depending on your interactions with us (e.g., appointment reminders, follow-ups).
  • Message and data rates may apply, based on your mobile carrier plan.
  • Consent is not a condition of purchase. You are never required to consent to SMS messaging to receive our Services.
  • Opt out at any time by replying STOP to any message. You will receive a one-time confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again.
  • Reply HELP for assistance, or contact us at support@commonhealthrx.com.
  • Carriers are not liable for delayed or undelivered messages.

This SMS program is separate from any marketing email program; opting out of SMS does not opt you out of email communications, and vice versa.

6. Payments

Prices for Services and medications are displayed at checkout or communicated during your consultation. Charges are processed through our third-party payment processor. Some Services (e.g., prescription fulfillment) are charged only after a licensed provider approves treatment following your evaluation, as described at the point of purchase. Refunds, where applicable, are handled in accordance with our refund practices communicated to you directly.

7. User Conduct

You agree not to: (a) provide false or misleading health information; (b) use the Site for any unlawful purpose; (c) attempt to interfere with the security or proper functioning of the Site; or (d) impersonate another person when using the Services.

8. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is owned by or licensed to CommonHealth and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, COMMONHEALTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC MEDICAL OUTCOME, WEIGHT LOSS RESULT, OR TREATMENT RESULT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMMONHEALTH AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO COMMONHEALTH IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Kentucky, and you consent to jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
